This privacy and cookies policy applies to the website www.emasys.hr owned and managed by EMASYS d.o.o., registered in Croatia with its head office at 10000 Zagreb, Ul. Božidara Magovca 62 (“Company”, "We").

This document sets out our policies regarding the collection, use or disclosure of specific personal information (“Personal data”) linked to your use of this website. Any personal data provided or collected through www.emasys.hr is controlled by Emasys d.o.o.. By using the website, we assume you have understood and accepted the contents of this policy.

1. PERSONAL DATA COLLECTION AND USE

While using our Site, we may ask you to provide us with certain personally identifiable data that can be used to contact or identify you such as:

  • Name and surname

  • Telephone number (work or personal)
  • Other information relevant to your enquiry

We will only collect and use the personal data you voluntarily share with us via our website for specified, explicit and legitimate purposes, such as:

  • To contact you subsequently if you require further information

  • To occasionally inform users about existing and new services of the company, where you have explicitly chosen to receive other information from us for marketing purposes.

These third parties only receive the necessary information to carry out our instructions and will use the information exclusively for the intended purpose. 1.3. Marketing / Consent

We may collect and use your personal data to send you promotional materials only on the basis of legitimate interests (if any) or consent. Promotional materials include any product, service, company or offer information that you have not specifically requested but that may be relevant or interesting to you. We consider it our legitimate interest to send marketing communications to current and former clients as well as business partners. In all other cases we need your consent to send you such communications (e.g. e-newsletters).

We specifically ask you whether you wish to receive marketing communications from us on the contact page of this website. By ticking the tick-box on the Contact page you consent for your personal data to be used by us for marketing purposes. Once you have given your consent you have the right to withdraw it at any time. To opt-out from receiving fruther marketing communications, unsubscribe by clicking the link available in all such communications or by sending us an e-mail at zop@emasys.hr, after which your personal data shall no longer be used for marketing purposes. 

 

2. COOKIES

In order for this site to work properly and for us to be able to continue to improve the site and enhance your browsing experience, this site will download a small text file known as a „cookie“ on the device you are using to view our website.

2.1. The types of cookies we use

These can be 'session cookies' that expire as soon as you close your browser and 'peristent cookies' which remain on your device for a longer period of time until they expire (a matter of days, months or even years) or manually delete them. 3. SECURITY OF PERSONAL DATA

Universally-accepted technology standards and operational safety measures have been implemented to protect personal data from loss, abuse, alteration, or destruction. All partners, employees and other responsible persons are required to keep personal data confidential and only authorized personnel has access to this information.

We ask you to be careful when sending personal data via e-mail. E-mail is not considered a secure way of transmitting information. Because of the Internet's open nature, we cannot guarantee that any information stored on our servers or sent between us will always be protected from unauthorized access. By using this website you demonstrate that you understand and agree to assume these risks. In the unlikely situation when we believe that the security of your personal data in our possession has been compromised, we are obliged to inform you about it. We will inform you about this within the legally established time period.

3.1. Disclosure of data to authorized partners

Personal data is processed by authorized personnel within our organization. We do not disclose data to unauthorized third parties. However personal data may be forwarded to trusted partners or by statutory duty to the relevant public authorities in accordance with the General Data Protection Regulation.

Your data may be forwarded to:

a) service providers that help us run our business (e.g. administering and/or optimising our website and web application). Service providers are only allowed to access and use your personal data for the specific tasks based on our instruction;

b) relevant public agencies and authorities

  • when required by applicable law
  • in response to legal proceedings
  • in response to a request from a competent law enforcement agency
  • to protect our rights, privacy, safety or property, or the public or
  • to enforce the terms of any agreement or the terms of our website.

All business partners that have access to your personal information are required keep your data confidential and secure in accordance to the contracts we have with them as well as with the obligations arising from the General Data Protection Act.

3.2. Retention of personal data

We take every reasonable step to ensure that your personal data is held in our database and that of our partners in line with the Data Protection Act.  We store your personal data for the minimum period necessary for the purposes set out in this privacy policy.

If a legal retention time exists, we will keep your data for the required period, after which we will permanently delete or destroy the data within a year. Personal data we process based on our legitimate interests are kept as long as the legitimate interest exists. When the legitimate interest ceases to exist, we delete or destroy the data within a year. Personal data we process on the basis of your explicit consent will be stored until you withdraw your consent. Should you withdraw your consent we will delete your personal data in the shortest time possible.

 

4. YOUR RIGHTS

Upon request you have the right to ask whether we collect and use your personal data and to request a physical or electronic copy of the information held about you for free in a comprehensible, legible and easily accessible form.

By law you also have the right to:

  • request access to, deletion, the portability or correction of your personal data
  • limit the use and disclosure of your personal data
  • revoke consent previously given to any of our data processing activities
  • object to the processing of your personal data (in certain circumstances) as well as to our way of handling your personal data
  • object to the processing of your personal data for direct marketing purposes
  • object to automated individual decision-making / profiling based on your personal data

You can exercise your rights by contacting us at zop@emasys.hr with "GDPR Rights" in the Subject line. We will reply to your request in writing as soon as possible and in any case not later than one month after receipt of your request.

In certain circumstances, we may not be able to uphold your rights, for example, when we are required to retain some of your personal data to satisfy our legal or contractual obligations.

Exercising your right to object to the processing of your personal data does not carry any negative consequences or sanctions. However, there is a possibility that after exercising your right, we will not be able to provide you with one or more of our services that cannot be provided without the use of personal data (e.g. customized communications, notifications about new products and services, etc.).

If, at any time, you have unresolved concerns with regards to the processing and protection of your personal data, you also have the right to complain to the competent data protection authorities – the Personal Data Protection Agency (www.azop.hr).

 

5. PERSONAL DATA BREACHES

In the event of a breach with regards to the personal data held in our database or database of any of our partners, we will report the breach to all relevant persons and the competent data protection authorities within 72 hours of becoming aware of the breach and assess whether it is necessary to inform the individuals the compromised personal data belongs to.

 

6. AGREEMENT WITH THIS PRIVACY AND COOKIES POLICY

By providing any personal data on the website you fully understand and unambiguously agree to the collection, processing and disclosure of such personal data within the Republic of Croatia as laid out in this Privacy and Cookies Policy.

We may change this policy from time to time. A notification of any modification to this policy will be clearly posted on this website.  We recommend you check this page occasionally to ensure that you’re happy with the changes.
